Practical reflections on the single inheritance law and the forced heirship under French law

Mai 2015

The European regulation 650/2012 of July 4, 2012 on successions will come into force in the 25 countries of the European Union on August 17. It will apply to all successions opened from that date.

This regulation sets out uniform rules on jurisdiction and applicable law in matters of succession for the 25 countries in which it applies. It is therefore an instrument of Community law which replaces the domestic rules of private international law for these countries. It does not create a new inheritance law because each country keeps its own, which is not modified. Its purpose is to eliminate conflicts of law in matters of succession between the countries concerned.

Bertrand SAVOURÉ, Althémis Paris notaire, presents the consequences of the entry into force of the regulation in a concrete manner.
